8. DEFENSE OF MARRIAGE INDEFENSIBLE
In a surprise move this past February, President Obama and Attorney General Eric Holder sent a letter to Congress announcing that the Department of Justice would no longer defend the Defense of Marriage Act in federal courts. “The President of the United States has made the determination that Section 3 of the Defense of Marriage Act (“DOMA”), 1 U.S.C. § 7, as applied to same-sex couples who are legally married under state law, violates the equal protection component of the Fifth Amendment,” Holder wrote. Let’s hope their views keep evolving.
