“Today, an overwhelming majority of Senators stepped up to protect the freedoms and rights of millions of Americans in same-sex and interracial marriages,” said Senator Tammy Baldwin (D-WI), one of the bill’s sponsors, in a statement following the bill’s passage.
Senate Majority Leader Chuck Schumer (D-NY) filed a motion on Monday to send the bill into a procedural vote, which is expected on Wednesday.
Senate Bill 107 would provide refuge for parents from conservative states, who could risk prosecution for allowing their trans children to access gender-affirming care.
“I said that, ‘The recent Supreme Court decision [overturning Roe] eroded a constitutional right to privacy. There’s a whole bunch of cases that have been decided based on a constitutional right to privacy that are in jeopardy,’ which he disagrees with,” Baldwin said of her remarks to Rubio.
Currently, only Susan Collins (R-ME) and Rob Portman (R-OH) have publicly expressed their support of the bill. Lisa Murkowski (R-AK) and Thom Tillis (R-NC) have both said that they will likely support the legislation as well.
The Respect for Marriage Act had been introduced by House Democrats to safeguard gay marriage following the Supreme Court’s decision to overturn Roe v. Wade in June.

The legislation included a new amendment that would create the first grant program dedicated to supporting LGBTQ+ survivors of domestic violence, stalking, and sexual assault.
While the bill is expected to pass in the House, which is controlled by the Democrats, it will likely face more hurdles in the Senate, where Democrats maintain a slim majority.
“Full equality has been denied to LGBTQ+ Americans and their families for far too long,” the President said.
“The Equality Act is a bill for us all: It is designed to ensure that everyone in this country is treated with respect, dignity, and equality, regardless of who we are or how we show up in the world.”
Passage of the Equality Act would provide yet another measure of protection for the LGBTQ+.
